Growers in the Gunns Plantations Woodlot Projects 2000 & 2001 passed resolutions to change the responsible entity to Primary on 12th June 2014 from the insolvent Gunns Limited.  Had the Growers not changed responsible entity, they would in all likelihood have received nothing from their investment.

On takeover, Primary was immediately met with a claim for substantial back-rent by the receivers and managers of Gunns Limited, and after some negotiations, this claim was resolved and the Growers (supported by Primary) made a payment to the receivers to enable the plantations to be harvested.  The receivers then refused to consent to harvest but the matter was resolved without proceedings being commenced by a deal between the receivers, Forico Pty Ltd and Primary which enabled harvest to take place.  Growers in all options have or are now receiving distributions.  It is believed that no Growers in any other scheme of which Gunns Limited was the responsible entity have received a distribution. 

Caveats

To protect the schemes’ interest in all head-leases, Primary has lodged caveats on all titles.
